Overview

This project required that we collect data on Supreme Court bankruptcy decisions. In order to assess the Court's decision process in each case, we reviewed the case files of retired Justices. A Justice's file for any given case typically has copies of draft opinions, letters and memoranda circulated within that Justice's chamber, and copies of correspondence between the Justices. Some Justices are more diligent about maintaining their file: the files for Justices Powell and Blackmun, for example, contain numerous handwritten notes and many personal documents, while Justice Marshall's files generally contain only copies of circulated drafts and form letters.
